Terms of Use
These terms cover your use of this website, which is operated by Byrom Rose Construction (“we”, “us”), a construction company based in Dallas, Texas. By using the site you agree to them. They are about the website. Any construction work we do for you is governed by a separate written agreement, and where that agreement and these terms differ, the agreement wins.
What this site is for
This site describes the work we do, shows photographs of projects we have built, and gives you a way to ask us for a quote. It is information, not advice. Nothing on it is a recommendation about your particular property, and you should not make decisions about your own project on the strength of it without talking to us or to a qualified professional.
Quotes are not contracts
Sending the quote form is a request for a conversation, not an order, and our reply to it is not an offer. Any figure we give you before a written proposal is an estimate and can change once we have seen the property and understood the scope. Pricing, scope, schedule, payment terms, warranty and how changes are handled are set out only in a written construction agreement signed by both of us. Until that is signed, neither of us is committed to anything.
For residential work in Texas, claims about construction defects are governed by Chapter 27 of the Texas Property Code, the Residential Construction Liability Act, which requires written notice to the contractor and an opportunity to inspect and offer to repair before a claim can go to court. The construction agreement sets out how that notice is given.
Licences and insurance
Texas does not issue a statewide general contractor licence. Trade work that Texas does licence, such as electrical, plumbing and HVAC, is carried out on our projects by tradespeople who hold the relevant Texas licence. We carry insurance appropriate to the work we do, and certificates are available on request as part of any project agreement.
The photographs and the words are ours
Every photograph on this site is of a project we built. The photographs, the text, the logo and the design of the site belong to us or to the people who licensed them to us, and are protected by copyright and trademark law. You may look at the site and share links to it. You may not copy, download, republish or use any photograph or other content for your own purposes, commercial or otherwise, without our written permission. Using a picture of a house we built to advertise someone else is the specific thing this paragraph exists to stop.
What you agree not to do
- Use the site or the quote form for anything unlawful, or to send us anything that is false, abusive or belongs to someone else.
- Try to interfere with the site, probe it, scrape it, or overload it.
- Pass yourself off as us, or suggest we endorse something we have not.
Links to other sites
Where the site links out, it is for convenience. We do not control those sites and are not responsible for what is on them.
No warranty for the website
The site is provided as it is. We try to keep it accurate and available, and we do not promise that it always will be, that it is free of errors, or that it will suit any particular purpose. To the fullest extent Texas law allows, we disclaim all warranties about the website itself, express or implied. This paragraph is about the website. It says nothing about the warranties in a construction agreement, which are set out there.
Limit on liability
To the fullest extent Texas law allows, we are not liable for any indirect, incidental, consequential or special loss arising from your use of this website, or for any loss of data, profit or business connected with it. Nothing in these terms limits liability that cannot be limited under Texas law.
Texas law, Dallas County
These terms are governed by the laws of the State of Texas without regard to its conflict of laws rules. Any dispute about the website will be heard in the state or federal courts located in Dallas County, Texas, and you agree to that venue. Disputes about construction work are handled as the construction agreement provides.
Changes
We may update these terms. When we do, the effective date at the top of this page changes, and continuing to use the site after that means you accept the new terms.
